3. Nature of Service

NAMA AI is a SaaS platform for travel businesses, including:

  • CRM and lead management
  • Itinerary creation
  • Quotations, invoices, and vouchers
  • Automation and communication tools
  • AI-assisted workflows

NAMA does not provide travel services and does not act as a travel agent.

4. User Accounts

Users may include owners, administrators, employees, and authorised users of client organisations. You are responsible for:

  • Maintaining account confidentiality
  • All activities under your account
  • Ensuring compliance with these Terms

5. Acceptable Use

You agree not to:

  • Use the platform for unlawful purposes
  • Misuse or unlawfully process customer data
  • Send unsolicited or spam communications
  • Attempt unauthorised access or disrupt services
  • Copy, modify, reverse engineer, or resell the platform

6. Subscriptions and Payments

  • Services are provided on a subscription basis
  • Fees are billed in advance
  • Payments are non-refundable unless agreed otherwise
  • Non-payment may result in suspension or termination
  • Pricing may change with prior notice

7. Data Ownership

  • You retain ownership of all business data
  • NAMA processes data solely to provide services
  • No ownership rights are claimed over your data

8. AI Features

AI-generated outputs may include itineraries, recommendations, or communications. These outputs:

  • Are generated automatically
  • May not be accurate or complete
  • Must be reviewed before use

9. Third-Party Services

The platform may integrate with third-party services. NAMA is not responsible for:

  • Third-party service availability
  • Third-party data handling practices

10. Data Hosting

Data is hosted on infrastructure located in the United States. By using the platform, you consent to cross-border data transfer.

11. Availability

Service availability is not guaranteed. Maintenance, updates, or interruptions may occur.

12. Termination

Access may be suspended or terminated if:

  • Terms are violated
  • Payments are overdue
  • Misuse is detected

You may discontinue use at any time.

13. Limitation of Liability

To the maximum extent permitted by law:

  • NAMA is not liable for indirect or consequential damages
  • Liability is limited to fees paid in the previous three months

14. Indemnity

You agree to indemnify NAMA against claims arising from:

  • Your use of the platform
  • Your data or business operations

15. Governing Law

These Terms are governed by the laws of India. Jurisdiction: Bengaluru, Karnataka.

These Terms may be updated from time to time. Continued use constitutes acceptance.

Enterprise SaaS Agreement

1. Parties

This Agreement is between Narayan Mallapur (NAMA AI) and the Client Organisation.

2. Scope

Provision of NAMA AI SaaS platform including CRM, automation, and AI tools.

3. License

A non-exclusive, non-transferable licence is granted for internal business use.

4. Pricing and Payment

  • Pricing is defined in a separate agreement
  • Payment terms: Net 15 or Net 30 unless otherwise agreed
  • Late payments may incur penalties

5. Data Ownership

  • Client retains full ownership of data
  • NAMA acts as data processor

6. Confidentiality

Both parties must protect confidential information.

7. Service Levels

  • Target uptime: 99% or higher
  • Critical support response: within 4 hours
  • Standard support response: within 24 hours

8. Security

Industry-standard safeguards and role-based access controls are implemented.

9. Term and Termination

  • Minimum term as agreed
  • Termination permitted for breach or non-payment

10. Limitation of Liability

Liability is limited to fees paid in the previous six months.

11. Governing Law

Jurisdiction: Bengaluru, Karnataka, India.

Data Processing Agreement (DPA)

2. Subject Matter

Processing of personal data for providing SaaS services.

3. Types of Data

4. Purpose

Data is processed solely to provide NAMA AI services.

5. Processor Obligations

NAMA shall:

  • Process data only on instructions from the client
  • Ensure confidentiality
  • Implement security measures
  • Assist with data subject rights
  • Notify of data breaches without undue delay

6. Subprocessors

NAMA may use subprocessors such as cloud providers and communication tools. NAMA remains responsible for their compliance.

7. International Transfers

Data may be transferred to the United States with safeguards in place.

8. Data Breach

NAMA will notify the client promptly upon becoming aware of a breach.

9. Data Deletion

Upon termination, data will be deleted within a reasonable timeframe unless legally required.

10. Audit Rights

Clients may request reasonable information regarding data protection practices.
